dc.descriptionThe article explores the existence of grounds for criminalization of anti-competitive concerted actions. The phenomenon of economic competition as an object of legal protection is examined, and the social danger of restricting competition is outlined. The prevalence of various types of anti-competitive concerted actions, their economic and legal nature, in particular, the differences in the characteristics of concerted actions that are anti-competitive in effect and anti-competitive in object (hard core cartels), and the significance of these characteristics for the legal regulation of combating these offenses are investigated. The significant prevalence of collusion among participants in public procurement procedures is established, and the likely reasons for this situation are considered, in particular, their clandestine nature, the lack of procedural tools for their investigation within the framework of the administrative procedure, the feasibility of using covert investigative actions for their investigation, and the ineffectiveness of administrative fines on legal entities in terms of performing preventive functions to prevent such collusions. Based on the results of the study, a conclusion is made about the existence of grounds for criminalization of hard core cartels, especially collusion among participants in public procurement procedures. At the same time, the state of legal regulation of other types of anti-competitive concerted actions does not provide sufficient grounds to consider it ineffective and does not provide sufficient grounds to see the need for their criminalization.
dc.description.abstractУ статті досліджується наявність підстав криміналізації антиконкурентних узгоджених дій. Розглядається феномен економічної конкуренції як об’єкта правової охорони та обґрунтовується суспільна небезпека обмеження конкуренції. Досліджується поширеність різноманітних видів антиконкурентних узгоджених дій, відмінності їхньої економіко-правової природи, характеристика узгоджених дій, які є антиконкурентними за ефектом і антиконкурентними за метою (жорстких картелів), вплив цих характеристик на правове регулювання боротьби з цими правопорушеннями. Встановлено значну поширеність такого виду антиконкурентних узгоджених дій, як змови учасників процедур публічних закупівель. Визначені як вірогідні причини такої ситуації неефективність процесуальних інструментів їхнього розслідування в рамках адміністративної процедури й потреба у використанні для цього негласних слідчих (розшукових) дій, неефективність адміністративних штрафів на юридичних осіб у частині виконання ними каральних і превентивних функцій. Результати дослідження вказують на наявність підстав для криміналізації жорстких картелів, особливо змов учасників процедур публічних закупівель. Водночас стан правового регулювання інших видів антиконкурентних узгоджених дій не дає достатніх підстав вважати його неефективним і не дає достатніх підстав вбачати потребу в їхій криміналізації.
