dc.descriptionThe article examines important issues of legal regulation of self-governing organizations of arbitration managers in the context of modern realities. The relevance of the topic is due to the important function of the institute of self-regulation of representatives of professional activity as a necessary component of legal regulation in the state as a whole. The author analyzes the regulatory framework that regulates the procedure for the creation and operation of self-governing organizations of arbitration managers; examines the features of the functioning of this institute in conditions of permanent changes in legislation. The emphasis is on the fact that with the normal functioning of self governing organizations of arbitration managers, an effective competitive environment is created, unfair competition disappears, and instead the exchange of practical experience and information improves, the qualification of arbitration managers increases, and modern opportunities for training are created. The methodology of the issue under study is based on a comprehensive approach that combines comparative legal analysis, a systemic approach and a formal-logical method. A detailed analysis of national legislation and scientific sources is used. The results of the analysis indicate an insufficient level of legislative regulation of the creation and activities of self-governing organizations in general, and in the field of self-regulation of arbitration managers in particular. However, there are positive trends regarding the existing practical implementation of existing norms in the context of the real activities of the National Association of Arbitration Managers of Ukraine.
dc.description.abstractУ статті досліджено важливі питання правового регулювання самоврядних організацій арбітражних керуючих у контексті сучасних реалій. Актуальність теми обумовлена важливою функцією інституту саморегулювання представників професійної діяльності як вагомою складовою правового регулювання в державі загалом. Проаналізовано нормативно-правову базу, що регулює порядок створення та діяльності самоврядних організацій арбітражних керуючих; досліджено особливості функціонування цього інституту в умовах перманентної зміни законодавства. Акцентовано увагу на тому, що за нормального функціонування самоврядних організацій арбітражних керуючих створюється ефективне конкурентне середовище, зникає недобросовісна конкуренція, натомість поліпшується обмін практичним досвідом та інформацією, підвищується кваліфікація арбітражних керуючих, створюються сучасні можливості для навчання. Методологія досліджуваного питання ґрунтується на комплексному підході, що поєднує порівняльно-правовий аналіз, системний підхід і формально-логічний метод. Використано детальний аналіз національного законодавства та наукових джерел. Результати проведеного аналізу свідчать про недостатній рівень законодавчого врегулювання створення й діяльності самоврядних організацій загалом і в сфері саморегулювання арбітражних керуючих зокрема. Однак позитивними є тенденції щодо наявної практичної реалізації вже існуючих норм у контексті реальної діяльності Національної Асоціації арбітражних керуючих України.
