dc.descriptionThe article analyzes the concept of legal status as a legal category and examines its structure, examines and summarizes the views of scientists regarding the legal status of a forensic expert in accordance with the current legislation of Ukraine, and proposes an author’s classification of the types of legal status of a forensic expert. The legal status of a forensic expert is proposed to be considered as a systemic entity, the basis of which is the main elements: the rights and duties of a forensic expert, as well as additional ones: responsibility, scientific competence, guarantees of the forensic expert’s independence and the correctness of his conclusion. The author’s classification of the types of legal status of a forensic expert is proposed, the basis for classification is the type of judicial proceedings, the type of subject of forensic expert activity, the type (subtype) of expertise.
dc.description.abstractУ статті проаналізовано поняття правового статусу як правову категорію та досліджено його структуру, розглянуто й узагальнено погляди вчених щодо правового статусу судового експерта відповідно до чинного законодавства України. Правовий статус судового експерта запропоновано розглядати як системне утворення, основу якого складають основні елементи: права та обов’язки судового експерта, а також додаткові: відповідальність, наукова компетенція, гарантії незалежності судового експерта та правильності його висновку. Надано авторську класифікацію видів правового статусу судового експерта, підставами для класифікації у якій виступають вид судочинства, вид суб’єкта судово-експертної діяльності, вид (підвид) експертизи.
