dc.descriptionThe article is devoted to the issues of definition and analysis of virtual currency for the legalization of income obtained through criminal means. The most common methods of legalization of income obtained through criminal means are analyzed. The relevance of the chosen topic is influenced by both the rapid development of technologies and the complexity of combating and preventing crime in this area, which is determined by the technical features of these processes. This contributes to the increase of crimes involving the use of cryptocurrencies, in particular crimes involving the legalization of illegally obtained funds. The current legislative and regulatory acts, implementation and carrying out of calculations in virtual currencies were analyzed. There is an increase in the number of transactions concluded with virtual currencies, but there is still no unified approach to the legal regulation of virtual assets in the state. The high capitalization of the crypto-currency market increases the number of their users and expands the scope of application of these currencies in calculations at the international level. The trends regarding the popularization of the use of virtual currencies in illegal financial schemes aimed at the legalization of income obtained through criminal means, in the vast majority of which are received in cash form, are indicated.
dc.description.abstractСтаття присвячена питанням визначення та аналізу віртуальної валюти щодо легалізації доходів, одержаних злочинним шляхом. На актуальність обраної теми впливають як швидкий розвиток технологій, так і складність у протидії та запобіганні злочинності в цій сфері, що обумовлюється технічними особливостями цих процесів, а це зі свого боку сприяє збільшенню правопорушень з використанням криптовалют, зокрема злочинів щодо легалізації доходів, одержаних злочинним шляхом. Проаналізовано чинні законодавчо-нормативні акти. Спостерігається зростання кількості угод, що укладаються з віртуальними валютами, проте й досі єдиного підходу до правового регулювання віртуальних активів у державі немає. Висока капіталізація ринку криптовалют збільшує кількість їх користувачів та розширює сферу застосування цих валют у розрахунках на міжнародному рівні. Зазначено тенденції щодо популяризації використання віртуальних валют у протиправних фінансових схемах, направлених на легалізацію доходів, одержаних злочинним шляхом, здебільшого, які отримані в готівковій формі.
